Unauthorized Practice of Professionals
(N.J.S.A. 2C:21-20 et. seq.)
Unauthorized Practice of Medicine: Under N.J.S.A. 2C:21-20, a person is guilty of unauthorized practice of medicine if he knowingly does not possess a license or permit to practice medicine and surgery or podiatric medicine, or knowingly has had the license or permit suspended, revoked or otherwise limited by an order entered by the State Board of Medical Examiners, and he:
Engages in that practice;
Exceeds the scope of practice permitted by the board order;
Holds himself out to the public or any person as being eligible to engage in that practice;
Engages in any activity for which such license or permit is a necessary prerequisite, including, but not limited to, the ordering of controlled dangerous substances or prescription legend drugs from a distributor or manufacturer; or
Practices medicine or surgery or podiatric medicine under a false or assumed name or falsely impersonates another person licensed by the board.
3rd Degree Offense: The unauthorized practice of medicine is a 3rd degree offense punishable by up to 5 years in New Jersey State Prison.
Unlicensed Practice of Acupuncture: Under N.J.S.A. 2C:20.1, a person is guilty of the unauthorized practice of acupuncture if he does not possess a license to practice acupuncture, or his license is suspended, revoked or otherwise limited by an order entered by the Acupuncture Examining Board, and, so knowing, he:
Engages in that practice;
Exceeds the scope of practice permitted by the board order;
Holds himself out to the public or any person as being licensed to engage in that practice;
Engages in any activity for which a license is a necessary prerequisite; or
Practices acupuncture under a false or assumed name or falsely impersonates another person licensed by the board.
3rd Degree Offense: The unauthorized practice of acupuncture is a 3rd degree offense punishable by up to 5 years in New Jersey State Prison.
Unauthorized Practice of Psychology: Under N.J.S.A. 2C:21-20.2, a person is guilty of the unauthorized practice of psychology if he is required to be licensed to practice psychology pursuant to the "Practicing Psychology Licensing Act," and he knowingly does not possess a license to practice psychology, or knowingly has had such license suspended, revoked or otherwise limited by an order entered by the State Board of Psychological Examiners, and he:
Engages in the practice of psychology;
Exceeds the scope of practice permitted by the board order;
Holds himself out to the public or any person as being eligible to engage in that practice;
Engages in any activity for which such license is a necessary prerequisite; or
Practices psychology under a false or assumed name or falsely impersonates another person licensed by the board.
*NOTE: This section shall not apply to any person who is authorized to practice psychology without a license pursuant to the "Practicing Psychology Licensing Act," or any other applicable law.
3rd Degree Offense: The unauthorized practice of psychology is a 3rd degree offense punishable by up to 5 years in New Jersey State Prison.
Unauthorized Practice of Chiropractic Services: Under N.J.S.A. 2C:21-20.3, a person is guilty of unauthorized practice of chiropractic services if he is required to be licensed to practice chiropractic pursuant to the "Chiropractic Board Act” and he knowingly does not possess a license to practice chiropractic, or knowingly has had such license suspended, revoked or otherwise limited by an order entered by the State Board of Chiropractic Examiners, and he:
Engages in the practice of chiropractic;
Exceeds the scope of practice permitted by the board order;
Holds himself out to the public or any person as being eligible to engage in that practice;
Engages in any activity for which such license is a necessary prerequisite; or
Practices chiropractic under a false or assumed name or falsely impersonates another person licensed by the board.
3rd Degree Offense: The unauthorized practice of chiropractic services is a 3rd degree offense punishable by up to 5 years in New Jersey State Prison.
*NOTE: This section shall not apply to any person who is authorized to practice chiropractic without a license pursuant to the "Chiropractic Board Act," or any other applicable law.
Unauthorized Practice of Social Work: Under N.J.S.A. 2C:21-20.4, a person is guilty of unauthorized practice of social work if he is required to be licensed or certified to practice social work pursuant to the "Social Workers' Licensing Act of 1991," and he knowingly does not possess a license or certification, or knowingly has had such license or certification suspended, revoked or otherwise limited by an order entered into by the State Board of Social Work Examiners, and he:
Engages in the practice of social work;
Exceeds the scope of practice permitted by the board order;
Holds himself out to the public or any person as being eligible to engage in that practice;
Engages in any activity for which such license or certification is a necessary prerequisite; or
Practices social work under a false or assumed name or falsely impersonates another person licensed or certified by the board.
3rd Degree Offense: The unauthorized practice of social work services is a 3rd degree offense punishable by up to 5 years in New Jersey State Prison.
*NOTE: This section shall not apply to any person who is authorized to practice social work without a license or certification pursuant to the "Social Workers' Licensing Act of 1991," or any other applicable law.
Unauthorized Practice of Psychoanalysis: Under N.J.S.A. 2C:21-20.5, a person is guilty of the unauthorized practice of psychoanalysis if he knowingly does not possess a certification to practice psychoanalysis or knowingly has had such certification suspended, revoked or otherwise limited by an order entered by the Director of the Division of Consumer Affairs in the Department of Law and Public Safety or his designee and the person:
Holds himself out to the public or any person as being a State certified psychoanalyst; or
Practices as a State certified psychoanalyst under a false or assumed name or falsely impersonates another person who is a State certified psychoanalyst.
3rd Degree Offense: The unauthorized practice of psychoanalysis is a 3rd degree offense punishable by up to 5 years in New Jersey State Prison.
Unauthorized Practice of Law: Under N.J.S.A. 2C:21-22(1)(a), a person is guilty of the unauthorized practice of law if the person knowingly engages in the unauthorized practice of law. Under N.J.S.A. 2C:21-22(1)(b), a person is guilty of unauthorized practice of law if the person knowingly engages in the unauthorized practice of law and: Creates or reinforces, by any means, a false impression that the person is licensed to engage in the practice of law; derives a benefit; or in fact causes injury to another.
4th Degree Offense: Unauthorized practice of law under subsection (1)(a) is a 4th degree offense which is punishable by up to 18 months in New Jersey State Prison.
3rd Degree Offense: Unauthorized practice of law under subsection (1)(b) is a 3rd degree offense which is punishable by up to 5 years in New Jersey State Prison.
“By Any Means” Defined: As used in this paragraph, "by any means" includes but is not limited to using or advertising the title of lawyer or attorney-at-law, or equivalent terms, in the English language or any other language, which mean or imply that the person is licensed as an attorney-at-law in the State of New Jersey or in any other jurisdiction of the United States.
"In Fact Causes Injury to Another": The phrase "in fact" indicates strict liability.
