Robbery (N.J.S.A. 2C:15-1)
Robbery: Pursuant to N.J.S.A. 2C:15-1, a person is guilty of robbery if, in the course of committing a theft, he:
Inflicts bodily injury or uses force upon another; or
Threatens another with or purposely puts him in fear of immediate bodily injury; or
Commits or threatens immediately to commit any crime of the 1st or 2nd degree.
"In the Course of Committing a Theft": An act shall be deemed to be included in the phrase "in the course of committing a theft" if it occurs in an attempt to commit theft or in immediate flight after the attempt or commission.
2nd Degree Offense: Robbery is a crime of the 2nd degree. A 2nd degree offense is punishable by up to 10 years in New Jersey State Prison (subject to the "No Early Release Act," meaning the defendant must serve at least 85% of the sentence before being eligible for release).
1st Degree Offense: Robbery is a crime in the 1st degree if in the course of committing the theft the actor attempts to kill anyone, or purposely inflicts or attempts to inflict serious bodily injury, or is armed with, or uses or threatens the immediate use of a deadly weapon. A 1st degree offense is punishable by up to 20 years in New Jersey State Prison (subject to the "No Early Release Act," meaning the defendant must serve at least 85% of the sentence before being eligible for release).
