Leader of an Organized Retail Theft Enterprise (N.J.S.A. 2C:20-11.2)


Leader of an Organized Retail Theft Enterprise:  Pursuant to N.J.S.A. 2C:20-11.2, a person is a leader of an organized retail theft enterprise if he conspires with others as an organizer, supervisor, financier or manager, to engage for profit in a scheme or course of conduct to effectuate the transfer or sale of shoplifted merchandise.


2nd Degree Offense:  Leader of organized retail theft enterprise is a crime of the 2nd degree, which is punishable by up to 10 years in New Jersey State Prison. 


Fines:  The court may impose a fine of up to $250,000 or 5 times the retail value of the merchandise seized at the time of the arrest, whichever is greater.
