Terroristic Threats (N.J.S.A. 2C:12-3)

Terroristic Threats:  Under N.J.S.A. 2C:12-3(a), a person is guilty of “Terroristic Threats” if:

  • He or she threatens to commit any crime of violence

  • With the purpose to terrorize another or

  • With the purpose to cause evacuation of a building, place of assembly, or facility of public transportation, or

  • To cause serious public inconvenience, or

  • In reckless disregard of the risk of causing such terror or inconvenience.

  • Terroristic threats under 2C:12-3(a) requires that the threat be serious and the psychological result (intended or risked) be grave.

Under N.J.S.A. 2C:12-3(b), a person is guilty of “Terroristic Threats if:

​

  • He or she threatens to kill another person,

  • With the purpose to put him in imminent fear of death,

  • Under circumstances reasonably causing the alleged victim to believe the immediacy of the threat and the likelihood that it will be carried out.

3rd Degree Offense:  Terroristic threats is a 3rd degree offense (it is a 2nd degree offense if it occurs during a declared period of national, State, or county emergency).  A 3rd degree crime carries a potential sentence of up to 5 years in prison.

Terroristic Threats and Domestic Violence:  Terroristic threats can be committed against any person, whether it is someone who meets the definition of a “domestic violence victim” or not.  However, when terroristic threats is committed against someone who meets the definition of a “domestic violence victim” then it triggers the protections of the Prevention of Domestic Violence Act.  When considering whether a reasonable person would have believed the threat at issue, the court can consider any past history of abuse.  See N.J.S.A. 2C:12-3, Comment 3.
