Simple Assault (N.J.S.A. 2C:12-1)

Simple Assault: Pursuant to N.J.S.A. 2C:12-1, simple assault occurs if the person:

Attempts to cause or purposely, knowingly, or recklessly causes bodily injury to another; or
-
Negligently causes bodily injury to another with a deadly weapon; or
-
Attempts by physical menace to put another in fear of imminent serious bodily injury.

Simple Assault Definitions:

“Bodily Injury” Defined: “Bodily Injury” means physical pain, illness, or any impairment of physical condition.

“Significant Bodily Injury” Defined: “Significant Bodily Injury” means bodily injury which creates a temporary loss of the function of any bodily member or organ or temporary loss of any one of the five senses.

“Serious Bodily Injury” Defined: “Serious Bodily Injury” means bodily injury which creates a substantial risk of death, or which causes serious and permanent disfigurement, or which causes protracted loss or impairment of the function of any bodily member or organ.

“Deadly Weapon” Defined: “Deadly Weapon” means any firearm or other weapon, device, instrument, material, or substance (whether animate or inanimate) which in the manner it is used or is intended to be used, is known to be capable of producing death or serious bodily injury or which in the manner it is fashioned would lead the victim reasonably to believe it to be capable of producing death or serious bodily injury.​

Disorderly Persons Offense: Simple assault is a disorderly persons offense, which is punishable by up to 6 months in jail.

Petty Disorderly Persons Offense: Simple assault is a petty disorderly persons offense if it is committed in a fight or scuffle entered into by mutual consent. A petty disorderly persons offense is punishable by up to 30 days in jail.
