Criminal Sexual Contact
(N.J.S.A. 2C:14-3)
Criminal Sexual Contact: Under N.J.S.A. 2C:14-3(b), an actor is guilty of criminal sexual contact if he commits an act of sexual contact with the victim under any of the circumstances set forth in section 2C:14-2c. (1) through (5) (i.e., actor uses coercion but no severe personal injury; victim is on probation, parole, or detained and the actor has supervisory power over victim; victim is 16-17 years-old and actor is a relative, authority figure, or guardian; victim is between 13-15 years-old and actor is 4+ years older than victim).
4th Degree Offense: Criminal sexual contact is a 4th degree offense, which is punishable by up to 18 months in New Jersey State Prison.
Aggravated Criminal Sexual Contact: Under N.J.S.A. 2C:14-3(a), an actor is guilty of aggravated criminal sexual contact if he commits an act of sexual contact with the victim under any of the circumstances set forth in 2C:14-2a. (2) through (7) (i.e., 13-15 year-old victim and act was done by relative, authority figure, or guardian; act was committed during commission of certain other crimes; actor was armed; use of coercion/no consent; victim helpless or incapacitated).
“Sexual Contact” Defined: "Sexual contact" means an intentional touching by the victim or actor, either directly or through clothing, of the victim's or actor's intimate parts for the purpose of degrading or humiliating the victim or sexually arousing or sexually gratifying the actor. Sexual contact of the actor with himself must be in view of the victim whom the actor knows to be present.
3rd Degree Offense: Aggravated criminal sexual contact is a crime of the 3rd degree, which is punishable by up to 5 years in New Jersey State Prison.
