Criminal Mischief

(N.J.S.A. 2C:17-3)


Criminal Mischief: Under N.J.S.A. 2C:17-3(a), a person is guilty of criminal mischief if he or she:


  • Damages Property of Another: Purposely or knowingly damages tangible property of another, or damages tangible property of another recklessly or negligently in the employment of fire, explosives, or other dangerous means;


  • Tampers With Property of Another: Purposely, knowingly, or recklessly tampers with tangible property of another so as to endanger person or property, including the damaging or destroying of a rental premises by a tenant in retaliation for institution of eviction proceedings.


Grading of Criminal Mischief:


  • 3rd degree: Under N.J.S.A. 2C:17-3(b)(1), criminal mischief is a crime of the 3rd degree if the actor purposely or knowingly causes loss of $2,000.00 or more.  A 3rd degree offense is punishable by up to 5 years in prison.

 

  • 4th Degree: Under N.J.S.A. 2C:17-3(b)(2), criminal mischief is a crime of the 4th degree if the actor causes loss between $500 - $2,000.

 

  • Disorderly Persons Offense: Under N.J.S.A. 2C:17-3(b)(2), criminal mischief is a disorderly persons offense if the actor causes loss of $500 or less.

 

*NOTE:  There are special rules for when criminal mischief is committed at certain locations (for example, at research facilities, airports, gravesites, public utility service sites, etc.)
