Domestic Violence Pre-Trial Release Conditions (N.J.S.A. 2C:25-26)
Pre-Trial Release Conditions: When a defendant charged with an offense involving domestic violence is released from custody, the Court may order certain pre-trial release conditions that prohibit the defendant from:

Having contact with the alleged victim, minor children, and/or the alleged victim’s family;

Returning to the alleged victim’s residence (even if it is also the defendant’s residence);

Returning to the alleged victim’s place of employment and/or school;

Harassing the alleged victim, or the alleged victim’s friends, co-workers, or relatives;
-
Possessing weapons.

The Court may additionally order home detention for the defendant, and can even add electronic monitoring via an ankle monitor. In these circumstances, the defendant is only allowed to leave the home for scheduled religious meetings, emergency medical visits, court appearances, and meetings with his attorney. The Court may also allow the defendant to leave the home for other reasons if approved by the Court in advance.
