Possession/Distribution of Prescription Drugs (2nd Degree): Under N.J.S.A. 2C:35-10.5(a)(4), a person who knowingly distributes or possesses or has under his control with intent to distribute a prescription legend drug or stramonium preparation in an amount of 100 or more dosage units unless lawfully prescribed or administered by a licensed physician, veterinarian, dentist or other practitioner authorized by law to prescribe medication is guilty of a crime of the 2nd degree. A 2nd degree offense is punishable by up to 5 years in New Jersey State Prison. This offense also carries the possibility of the imposition of a fine of up to $300,000.

Possession/Distribution of Prescription Drugs (3rd degree): Under N.J.S.A. 2C:35-10.5(a)(3), a person who knowingly distributes or possesses or has under his control with intent to distribute a prescription legend drug or stramonium preparation in an amount of at least 5 but fewer than 100 dosage units unless lawfully prescribed or administered by a licensed physician, veterinarian, dentist or other practitioner authorized by law to prescribe medication is guilty of a crime of the 3rd degree. A 3rd degree offense is punishable by up to 5 years in New Jersey State Prison. This offense also carries the possibility of the imposition of a fine of up to $200,000.

Distribution of Prescription Drugs (4th Degree): Under N.J.S.A. 2C:35-10.5(a)(2), a person who knowingly distributes for pecuniary gain or possesses or has under his control with intent to distribute for pecuniary gain a prescription legend drug or stramonium preparation in an amount of 4 or fewer dosage units unless lawfully prescribed or administered by a licensed physician, veterinarian, dentist or other practitioner authorized by law to prescribe medication is guilty of a crime of the 4th degree. A 4th degree offense is punishable by up to 18 months in New Jersey State Prison.

A 4th degree offense is punishable by up to 18 months in New Jersey State Prison, and a discretionary fine of up to $10,000.

A disorderly persons offense is punishable by up to 6 months in jail and a discretionary fine of up to $1,000.
