Tampering With OR Fabricating Physical Evidence: Under N.J.S.A. 2C:28-6, a person commits the crime of tampering with or fabricating physical evidence if, believing that an official proceeding or investigation is pending, or about to be instituted, he:
Alters, Destroys, Conceals, Removes Physical Evidence: Alters, destroys, conceals, or removes any article, object, record, document, or other thing of physical substance with purpose to impair its verity or availability in such proceeding or investigation.
Creates Evidence With Purpose to Mislead: Makes, devises, prepares, presents, offers, or uses any article, object, record, document, or other thing of physical substance knowing it to be false and with the purpose to mislead a public servant who is engaged in such proceeding or investigation.
4th Degree Offense: Tampering with or fabricating physical evidence is a crime in the 4th degree, punishable by up to 18 months in New Jersey State Prison.
