Eluding Law Enforcement
(N.J.S.A. 2C:29-2(B))
Eluding Law Enforcement (2nd Degree): Under N.J.S.A. 2C:29-2(b), any person, while operating a motor vehicle on any street or highway in the State or any vessel on the waters of this State, who knowingly flees or attempts to elude any police or law enforcement officer after having received any signal from such officer to bring the vehicle or vessel to a full stop AND the flight or attempt to elude creates a risk of death or injury to any person commits a 2nd degree offense. A 2nd degree offense carries a presumption of imprisonment and a sentence of up to 10 years in New Jersey State Prison.
Eluding Law Enforcement (3rd degree): Under N.J.S.A. 2C:29-2(b), any person, while operating a motor vehicle on any street or highway in the State or any vessel on the waters of this State, who knowingly flees or attempts to elude any police or law enforcement officer after having received any signal from such officer to bring the vehicle or vessel to a full stop commits 3rd degree eluding. A 3rd degree offense is punishable by up to 5 years in New Jersey State Prison.
*NOTE RE: Motor Vehicle or Vessel Laws: There is a permissive inference that flight or attempt to elude creates a risk of death or injury to any person if the person’s conduct involves violation of motor vehicle or vessel laws.
*NOTE RE: Driver’s License Suspension: A person convicted of eluding must have their driver’s license suspended for a period of 6 to 24 months.
