No Early Release Act ("NERA") (N.J.S.A. 2C:43-7.2)

“No Early Release Act”:  Pursuant to N.J.S.A. 2C:43-7.2, a court imposing a sentence of incarceration for certain 1st or 2nd degree offenses must fix a minimum term of 85% of the sentence imposed, during which the defendant shall not be eligible for parole.  The following are NERA offenses:

  • Murder

  • Manslaughter

  • Aggravated Manslaughter

  • Vehicular Homicide

  • Aggravated Assault (2nd degree)

  • Disarming a Law Enforcement Officer

  • Kidnapping

  • Aggravated Sexual Assault

  • Sexual Assault

  • Robbery

  • Carjacking

  • Aggravated Arson

  • Burglary

  • Extortion

  • Booby Traps in Manufacturing or Distribution Facilities

  • Strict Liability for Drug Induced Deaths

  • Terrorism

  • Producing or Possessing Chemical Weapons, Biological Agents, or Nuclear or Radiological Devices

  • Racketeering (1st degree)

  • Firearms Trafficking

  • Causing or Permitting a Child to Engage in a Prohibited Sexual Acts to be Reproduced, Exhibited, or Performed

Parole Supervision:  A court sentencing someone for a NERA offense must also impose a term of parole supervision that follows the period of incarceration.  For a 1st degree offense, 5 years of parole and for a 2nd degree offense 3 years of parole.
