Seeking to End Probation Early

Motions for Early Discharge From Probation

The Court, on application by the defendant, has the discretion to discharge the defendant from probation early.  So, for example, if a person was sentenced to a term of 2 years of probation, he may submit for an early discharge from probation after completing 1 year of probation.  In this Motion, defense counsel explains to the Court how well the defendant is doing on probation, whether he has completed any treatment requirements, whether he has been in compliance with all of the terms of his probation, etc.

Court routinely like to grant these motions for people who are doing well on probation.  The reason for this is it is a "reward" for good behavior, and it also allows probation to focus its resources on those who need more help or supervision.  Once a motion for early discharge from probation is granted, the individual's probation is immediately terminated and their obligations to probation end.  If the motion for early discharge from probation is denied, the individual may refile another Motion again in the future.
