Impersonating a Public Servant or Law Enforcement Officer (N.J.S.A. 2C:28-8)


Impersonating a Law Enforcement Officer: Under N.J.S.A. 2C:28-8(b), a person impersonates a law enforcement officer if he falsely pretends to hold a position as an officer or member or employee, or agent of any organization or association of law enforcement officers with the purpose to induce another to submit to such pretended official authority or otherwise to act in reliance upon that pretense.

  • 4th Degree Offense: Impersonating a law enforcement officer is a 4th degree offense, punishable by up to 18 months in New Jersey State Prison.


Impersonating a Public Servant: Under N.J.S.A. 2C:28-8(a), a person impersonates a public servant if he or she falsely pretends to hold a position in the public service with purpose to induce another to submit to such pretended official authority or otherwise to act in reliance upon that pretense.

  • Disorderly Persons Offense:  Impersonating a public servant is a disorderly persons offense, which is punishable by up to 6 months in jail.
