False Reports to Law Enforcement
(N.J.S.A. 2C:28-4)
Falsely Incriminating Another: Under N.J.S.A. 2C:28-4(a), a person is guilty of making a false report to law enforcement if he knowingly gives or causes to be given false information to any law enforcement officer with the purpose to implicate another commits a crime.
2nd Degree Offense: If the false information which the actor gave or caused to be given would implicate the person in a crime of the 1st or 2nd degree, then the false report is a 2nd degree offense. A 2nd degree offense is punishable by up to 10 years in New Jersey State Prison.
*NOTE: Knowledge of the grade of the crime about which the defendant gave false information is not an element of the offense and it shall not be a defense that the defendant did not know the grade of the crime.
3rd Degree Offense: All other offenses for falsely incriminating another are graded as a 3rd degree offense, which is punishable by up to 5 years in New Jersey State Prison.
Fictitious Reports: Under N.J.S.A. 2C:28-4(b), a person is guilty of making a factitious report if he or she:
Reports or causes to be reported to law enforcement authorities an offense or other incident within their concern knowing that it did not occur; OR
Pretends to furnish or causes to be furnished such authorities with information relating to an offense or incident when he knows he has no information relating to such offense or incident.
4th Degree Offense: Making fictious reports is a 4th degree offense which is punishable by up to 18 months in New Jersey State Prison.
