False Government Documents

(N.J.S.A. 2C:21-2.1)


Sale of False Government Documents: Under N.J.S.A. 2C:21-2.1(a), a person who knowingly sells, offers or exposes for sale, or otherwise transfers or possesses with the intent to sell, offer, or expose for sake, or otherwise transfer, a document, printed form, or other writing which falsely purports to be a driver’s license, birth certificate, or other document issued by a governmental agency and which could be used as a means of verifying a person’s identity, age, or other personal identifying information.

  • 2nd Degree Offense: False government documents under N.J.S.A. 2C:21-2.1(a) is a crime in the 2nd degree.  A 2nd degree offense is punishable by up to 10 years in New Jersey State Prison.

 

Creation of False Government Documents: Under N.J.S.A. 2C:21-2.1(b), a person who knowingly makes, or possess devices or materials to make, a document or other writing which falsely purports to be a driver’s license, birth certificate, or other document issued by a governmental agency and which could be used as a means of verifying a person’s identity or age or other personal identifying information.

  • 2nd Degree Offense: False government documents under N.J.S.A. 2C:21-2.1(b) is a crime in the 2nd degree.  A 2nd degree offense is punishable by up to 10 years in New Jersey State Prison.

 

Use of False Government Documents: Under N.J.S.A. 2C:21-2.1(c), a person who knowingly exhibits, displays, or utters a document or other writing which falsely purports to be a driver’s license, birth certificate, or other document issued by a governmental agency and which could be used as a means of verifying a person’s identity or age or other personal identifying information is guilty of a crime in the 3rd degree.

  • 3rd Degree Offense: Use of false government documents is a 3rd degree offense which is punishable by up to 5 years in New Jersey State Prison.

 

Possession of False Government Documents: Under N.J.S.A. 2C:21-2.1(d), a person who knowingly possesses a document or other writing which falsely purports to be a driver’s license, birth certificate, or other document issued by a governmental agency and which could be used as a means of verifying a person’s identity or age or any other personal identifying information is guilty of a crime of the 4th degree.

  • 4th Degree Offense: Possession of false government documents is a 4th degree offense which is punishable by up to 18 months in New Jersey State Prison.

 

*NOTE RE: Loss of Driver’s License: A person convicted of the sale, creation, use, or possession of false government documents must forfeit their driver’s license for a period of 6 months to 2 years.
