Drugs and Gun Laws (N.J.S.A. 2C:39-4.1)
Possession of Firearm While Committing Certain Drug Offenses: Any person who has in his possession any firearm while in the course of committing (or an attempt or conspiracy to commit) certain drug offenses is guilty of a crime in the 2nd degree (which is punishable by up to 10 years in New Jersey State Prison).
Use of Weapon (Other Than Firearm) During Commission of Certain Drug Offenses: Any person who has in his possession any weapon, except a firearm, with a purpose to use such weapon unlawfully against the person or property of another, while in the course of committing, attempting to commit, or conspiring to commit certain drug offenses, is guilty of a crime of the 2nd degree (which is punishable by up to 10 years in New Jersey State Prison).
Consecutive Sentence: The sentence imposed upon any person convicted of use of a weapon during the commission of a drug offense must be served consecutively to any conviction(s) for certain drug offenses.
