DEDR Penalties (N.J.S.A. 2C:35-5.11 & 2C:35-15)


DEDR Penalties:  Any person convicted of a drug offense in New Jersey is subject to a “Drug Enforcement Demand Reduction" fine.  Those fines are as follows:

  • 1st Degree Drug Offense:  $3,000 fine for a 1st degree offense.

  • 2nd Degree Drug Offense:  $2,000 fine for a 2nd degree offense.

  • 3rd Degree Drug Offense:  $1,000 fine for a 3rd degree offense.

  • 4th Degree Drug Offense:  $750 fine for a 4th degree offense.

  • Disorderly Persons or Petty Disorderly Persons Offense:  $500 fine for a disorderly persons or petty disorderly persons offense.


*NOTE:  Any out-of-pocket costs for a drug rehabilitation program may be applied to reduce the DEDR penalty, so long as the person provides proof of payment for such treatment AND the person successfully completes treatment.
