Domestic Violence Offenses

Domestic Violence “Victim” Defined: For domestic violence to be found, the defendant and the alleged victim must have a relationship to which the chapter applies. See N.J.S.A. 2C:25-19, Comment 2. In New Jersey, a “victim of domestic violence” is defined as any person over 18 years-old who has been subjected to domestic violence by a spouse, former spouse, someone with whom the defendant and alleged victim share a child in common, or any person with whom the defendant is or was previously in a dating relationship.  A “victim of domestic violence” also includes a person who is a present household member or was at any time a household member.  See N.J.S.A. 2C:25-19(d).

Crimes Classified as “Domestic Violence Offenses”: In New Jersey, the following offenses are considered to be “domestic violence” offenses, so long as the alleged victim meets the statutory definition of a “victim of domestic violence” (i.e., someone with whom the defendant has or had a dating relationship with or lives or used to live with). See N.J.S.A. 2C:25-19.

  2. Simple Assault / Aggravated Assault (2C:12-1)

  3. Terroristic Threats (2C:12-3)

  4. Kidnapping (2C:13-1)

  5. Criminal Restraint (2C:13-2)

  6. False Imprisonment (2C:13-3)

  7. Sexual Assault (2C:14-2)

  8. Criminal Sexual Contact (2C:14-3)

  9. Lewdness (2C:14-4)

  10. Criminal Mischief (2C:17-3)

  11. Burglary (2C:18-2)

  12. Criminal Trespass (2C:18-3)

  13. Harassment (2C:33-4)

  14. Stalking (2C:12-10)

  15. Criminal Coercion (2C:13-5)

  16. Robbery (2C:15-1)

  17. Contempt of a DV Order (2C:29-9(b))

  18. Any other crime involving risk of death or serious bodily injury to a person protected under the “Prevention of Domestic Violence Act of 1991 (2C:25-17 et al.)
