Alternatives to Incarceration

  • Probation:  Probation is a court-ordered period of supervision intended to be an alternative to incarceration.  Probation allows defendants to stay in the community under the supervision of a probation officer.  In New Jersey, an individual may be sentenced to a term of probation for anywhere from 1 to 5 years.  See N.J.S.A. 2C:45-2.  As part of probation obligations, the court may impose various conditions that are unique to the individual's case, along with the standard conditions of probation that apply in all cases.  For more information about probation in New Jersey CLICK HERE

  • Suspended Sentence:  Pursuant to N.J.S.A. 2C:43-2(b), the court may suspend the imposition of a sentence on a person who has been convicted of a crime.  How this works is the individual will be placed on probation and the custodial sentence will be suspended unless and until there is a reason to unsuspend the sentence.  Typically, a sentence is "unsuspended" if the individual fails to comply with the terms of probation.  In that scenario, the court would "unsuspend" the sentence and the individual will have to serve the time in custody.  However, if the person successfully completes probation, they will not have to serve any additional custodial time on the suspended sentence. 

  • Fines and/or Restitution:  Pursuant to N.J.S.A. 2C:43-2(b), the court may order the defendant to pay a fine or make restitution in lieu of a custodial sentence.

  • Community Service:  Pursuant to N.J.S.A. 2C:43-2(b), the court may order a defendant to serve a period of community service in lieu of a custodial sentence.

  • Night/Weekend Jail:  Pursuant to N.J.S.A. 2C:43-2(b)(7), the court has the authority to impose a jail sentence to be served at night or on the weekends.  Under these circumstances, the defendant would tern himself into the jail at a specified time for the night or on weekends, and then would be released at a specified time.  

  • Sheriff’s Labor Assistance Program (“SLAP”): The Sheriff’s Labor Assistance Program (“SLAP”) is a community-based program that provides an alternative to incarceration for individuals convicted of a non-violent criminal offense.  A person sentenced to SLAP earns “jail credit” by performing manual labor.  This enables the individual to maintain employment, provide for their family, and continue to be a productive member of society while serving their sentence.
