DUI 3rd Or Subsequent Offense
(N.J.S.A. 39:4-50(A)(3))
DUI 3rd or Subsequent Offense: For a 3rd or subsequent DUI violation, for either alcohol content over 0.08% or drugs, the person is subject to the below-listed penalties.​

Fines: A fine of $1,000.

Jail Time: The individual must serve 180 days in jail. However, the court has the discretion to lower that sentence to up to 90 served in an inpatient substance use disorder program (approved by the Intoxicated Driver Resource Center).

Driver’s License Suspension: Driver’s license suspension period of 8 years.

Ignition Interlock Device: A person convicted of a 3rd or subsequent DUI is required to install an Ignition Interlock Device in their motor vehicle during their period of driver’s license suspension and for 2 to 4 years after the driver’s license suspension period expires.

10-Year “Reset” Period: If the 3rd offense occurs more than 10 years after the 2nd offense, the court shall treat the 3rd conviction as a 2nd offense for sentencing purposes.
