DUI 2nd Offense (N.J.S.A. 39:4-50(a)(2))

DUI 2nd Offense:  Pursuant to N.J.S.A. 39:4-50(A)(2), a person convicted of a 2nd DUI (i.e. under the influence of alcohol 0.08% or higher OR drugs) is subject to the following penalties:​

  • Fine:  A fine between $500 - $1,000.

  • Community Service:  The person must complete 30 days of community service.

  • Jail Time:  The person will be subject to a jail sentence of 2 to 90 days, which cannot be suspended or served on probation.

  • Driver’s License Suspension:  The person will be subject to a driver’s license suspension for a period of 1 to 2 years.

  • Ignition Interlock Device:  A person convicted of a 2nd DUI is required to install an Ignition Interlock Device in their motor vehicle during their period of driver’s license suspension and for 2 to 4 years after the driver’s license suspension period expires.

  • Intoxicated Driver’s Resource Center:  A person convicted of a 2nd DUI must spend 48 hours attending an alcohol education program at the Intoxicated Driver’s Resource Center.  The individual may also be ordered to complete additional treatment that can last up to 4 months.

  • 10-Year “Reset” Period:  If the 2nd offense occurs more than 10 years after the 1st offense, the court shall treat the 2nd conviction as a 1st offense for sentencing purposes.
